Welcome to BizSim Game Studios ("BizSim", "we", "us", or "our"). These Terms of Service ("Terms") govern your access to and use of the games, applications, websites, and related services (collectively, the "Service") provided by BizSim Game Studios, an economy simulation game developer based in Istanbul, Turkey. Our games include Rise of Companies, Junkyard Tycoon, and any other games we publish.
Important: By accessing, downloading, installing, or using any of our games or services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree with any part of these Terms, you must immediately stop using the Service and uninstall our games.
By creating an account, downloading, installing, or otherwise using the Service, you enter into a binding agreement with BizSim Game Studios. These Terms apply to all visitors, users, and others who access or use the Service.
We may update these Terms from time to time. The updated Terms will be posted on this page with a revised effective date. We will make reasonable efforts to notify you of material changes, such as through an in-game notification or email. Your continued use of the Service after changes are posted constitutes your acceptance of the updated Terms. If you do not agree to the modified Terms, you must stop using the Service.
Our Privacy Policy explains how we collect, use, and protect your personal data. By agreeing to these Terms, you also acknowledge and consent to the practices described in the Privacy Policy.
Age Requirement: The Service is intended for users aged 13 and older. By using the Service, you represent and warrant that you are at least 13 years of age. If you are under the age of 13, you are strictly prohibited from accessing or using the Service. If you are between the ages of 13 and 18 (or the age of majority in your jurisdiction), you may only use the Service with the consent of a parent or legal guardian who agrees to be bound by these Terms.

Subject to your compliance with these Terms, BizSim Game Studios grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download, install, and use the Service on devices you own or control, solely for your personal, non-commercial entertainment purposes.

Certain features of the Service may require you to create or link an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
Our games may include virtual currencies (such as Diamonds in Junkyard Tycoon), virtual items, and other digital goods (collectively, "Virtual Items"). Virtual Items may be earned through gameplay, watching advertisements, inviting friends, or purchased with real money through in-app purchases.
Virtual Items have no real-world monetary value and cannot be redeemed for real money, goods, or any other items of monetary value from BizSim or any other party. Virtual Items are not transferable or exchangeable and may not be traded, sold, or otherwise transferred to other users or third parties, whether for real money, other Virtual Items, or anything else of value.
When you acquire Virtual Items, whether purchased or earned, you receive a limited, non-exclusive, non-transferable, revocable license to use those Virtual Items within the applicable game. You do not own the Virtual Items; BizSim retains all right, title, and interest in and to all Virtual Items.
All purchases of Virtual Items are final and non-refundable, except as required by applicable law or platform policy (such as Google Play or Apple App Store refund policies). You acknowledge that you will not receive a refund for any Virtual Items for any reason, including but not limited to account termination, whether voluntary or involuntary.
In-app purchases are processed through third-party platforms such as Google Play Store and Apple App Store. By making a purchase, you also agree to the applicable terms, conditions, and privacy policies of the respective platform.
BizSim reserves the right to manage, regulate, control, modify, adjust, or eliminate Virtual Items at any time, with or without notice. BizSim shall have no liability to you or any third party in the event that BizSim exercises any such rights. The prices for Virtual Items may be changed at any time without notice.
The Service may allow you to create, submit, post, or display content such as usernames, chat messages, feedback, suggestions, or other materials ("User Content").
By submitting User Content, you grant BizSim a non-exclusive, worldwide, royalty-free, perpetual, irrevocable, sublicensable, and transferable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform, and display such User Content in connection with the Service and BizSim's business operations, including for marketing and promotional purposes.

BizSim reserves the right, but has no obligation, to monitor, review, moderate, edit, or remove any User Content at our sole discretion, for any reason, including but not limited to content that we believe violates these Terms or is otherwise harmful or inappropriate. We may also restrict or ban users who repeatedly violate our content standards.
All content, features, and functionality of the Service, including but not limited to text, graphics, logos, icons, images, audio clips, video, animations, data compilations, software, code, game mechanics, designs, trademarks, trade names, trade secrets, and trade dress, are owned by BizSim Game Studios or its licensors and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.
The BizSim name, BizSim logo, Rise of Companies, Junkyard Tycoon, and all related names, logos, product and service names, designs, and slogans are trademarks of BizSim Game Studios. You may not use such marks without our prior written permission.
All rights not expressly granted to you under these Terms are reserved by BizSim Game Studios.
You agree to use the Service only for lawful purposes and in accordance with these Terms. You are solely responsible for your conduct while using the Service.

BizSim reserves the right to determine what constitutes a violation of these Terms and to take appropriate action, including but not limited to account suspension, termination, or legal action.
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
BizSim does not warrant that:
You use the Service at your own risk. No advice or information, whether oral or written, obtained from BizSim or through the Service shall create any warranty not expressly stated in these Terms.
We use third-party analytics tools, including but not limited to Google Analytics, Unity Analytics, and IronSource/LevelPlay, to collect data about your in-game activities and interactions. This data helps us understand how our games are used, improve gameplay experiences, optimize performance, and deliver more relevant advertisements.
Additionally, we collect information through advertising networks to deliver personalized ads to players. Our advertising partners may use cookies, device identifiers, and similar technologies to serve ads based on your interests.
By using the Service, you consent to the collection and processing of data as described in our Privacy Policy. For information about your privacy rights, including opt-out options, please refer to our Privacy Policy.
BizSim may, from time to time, update, patch, or modify the Service, including but not limited to adding or removing features, content, Virtual Items, game mechanics, or functionality. Such updates may be required to continue using the Service, and you agree that BizSim is under no obligation to provide updates or to maintain backward compatibility with previous versions of the Service.
BizSim may also perform scheduled or unscheduled maintenance, which may result in temporary interruptions of the Service. We will make reasonable efforts to minimize disruptions but are not liable for any downtime resulting from maintenance or updates.
BizSim reserves the right to discontinue the Service or any part thereof at any time, with or without notice, without liability to you.
We may suspend, restrict, or terminate your access to the Service at any time, without prior notice, for any reason, including but not limited to: violation of these Terms, suspected fraudulent or illegal activity, extended inactivity, or operational reasons. Upon termination, your license to use the Service is immediately revoked.
You may terminate your use of the Service at any time by uninstalling our games and ceasing all use of the Service. If you wish to request deletion of your account and associated data, please contact us at privacy@bizsim.com.
Upon termination, whether by you or by BizSim:
The following sections survive termination of these Terms: Intellectual Property, Virtual Items and In-App Purchases (to the extent applicable), No Warranty, Limitation of Liability, Indemnification, Dispute Resolution, Governing Law, and any other provisions that by their nature should survive termination.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL BIZSIM GAME STUDIOS, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, DATA, USE, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) THE SERVICE.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BIZSIM'S AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF: (A) THE AMOUNTS YOU HAVE PAID TO BIZSIM IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED UNITED STATES DOLLARS (US $100).
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOU. IN SUCH JURISDICTIONS, BIZSIM'S LIABILITY IS LIMITED TO THE FULLEST EXTENT PERMITTED BY LAW.
You agree to defend, indemnify, and hold harmless BizSim Game Studios and its officers, directors, employees, contractors, agents, licensors, partners, suppliers, and affiliates from and against any and all claims, demands, damages, obligations, losses, liabilities, costs, or expenses (including but not limited to reasonable attorney's fees) arising from or related to:
Before filing any formal legal proceeding, you agree to first attempt to resolve any dispute, claim, or controversy arising out of or relating to these Terms or the Service informally by contacting us at office@bizsim.com. We will attempt to resolve the dispute informally within thirty (30) days from the date we receive your notice. If the dispute is not resolved within that period, either party may proceed as outlined below.
If you are a resident of the United States and the informal resolution process described above does not resolve the dispute, you and BizSim agree that the dispute shall be resolved by binding individual arbitration, rather than in court. Arbitration shall be conducted under the rules of the American Arbitration Association (AAA) then in effect, and shall take place in a mutually agreed location or remotely via videoconference.
Class Action Waiver: YOU AND BIZSIM AGREE THAT EACH PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. Unless both parties agree otherwise, the arbitrator may not consolidate more than one person's claims and may not preside over any form of a representative or class proceeding.
Small Claims Exception: Notwithstanding the foregoing, either party may bring an individual action in small claims court for disputes within the jurisdiction of such court.
If you are not a resident of the United States, any dispute arising out of or relating to these Terms or the Service that cannot be resolved informally shall be submitted to the exclusive jurisdiction of the courts of Istanbul, Turkey.
These Terms and any dispute or claim arising out of or in connection with them or their subject matter shall be governed by and construed in accordance with the laws of the Republic of Turkey, without regard to its conflict of law provisions. Subject to the Dispute Resolution section above, the courts of Istanbul, Turkey shall have exclusive jurisdiction over any proceedings arising out of or relating to these Terms.
Neither BizSim nor you shall be liable for any failure or delay in performing obligations under these Terms where such failure or delay results from causes beyond the reasonable control of the affected party, including but not limited to: natural disasters (earthquakes, floods, hurricanes), epidemics or pandemics, war, terrorism, riots, civil unrest, government actions or orders, embargoes, sanctions, labor disputes or strikes, failures of third-party service providers, internet or telecommunications outages, power failures, cyberattacks, or any other event that is unforeseeable and beyond reasonable control. The affected party shall use reasonable efforts to mitigate the effects of the force majeure event and resume performance as soon as practicable.
If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid and enforceable, or if modification is not possible, severed from these Terms. The invalidity or unenforceability of any provision shall not affect the validity or enforceability of the remaining provisions, which shall continue in full force and effect.
These Terms, together with our Privacy Policy and any other policies or guidelines referenced herein, constitute the entire agreement between you and BizSim Game Studios regarding your use of the Service and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, regarding the Service.
No waiver of any term or condition set forth in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition. Any failure by BizSim to assert a right or provision under these Terms shall not constitute a waiver of such right or provision.
